WARRANTY POLICY

This Warranty Policy applies to all products sold under the LIVAROCKS brand.
This Warranty Policy supersedes all previous versions. The applicable warranty terms are those in effect at the time of purchase.
1. Warranty Coverage
LIVAROCKS warrants that its raised cedar planters are free from manufacturing defects in materials and workmanship at the time of delivery. This limited warranty applies only to defects that are present upon receipt of the product and does not extend to issues arising from use, environmental exposure, or normal wear over time.
This warranty is valid only for the original purchaser and is non-transferable, except where prohibited by applicable law.
2. Warranty Periods
Western Red Cedar components are covered for 12 (twelve) months from the date of delivery against manufacturing defects that were present at the time of delivery and become apparent under normal use.
Steel legs, fasteners, and hardware are covered for 6 (six) months from the date of delivery against manufacturing defects that were present at the time of delivery and become apparent under normal use.
3. What Is Covered
This warranty covers structural defects caused by manufacturing error, defective hardware or fasteners identified at delivery, and manufacturing defects in steel legs or surface coating that are clearly present at the time of delivery.
4. Wood Characteristics Disclaimer
Western Red Cedar is a natural material. Variations in color, grain, knots, small cracks, surface imperfections, cosmetic defects, and differences in appearance are normal and are not considered defects.
The presence or absence of knots or visual imperfections does not affect the structural integrity or intended outdoor use of the planter and is not covered under this warranty.
5. What Is Not Covered
This warranty does not cover wood movement, checking, cracking, splitting, warping, or dimensional variation caused by environmental exposure, humidity, temperature changes, or seasonal conditions.
Minor dimensional differences or tolerances in size are inherent to natural materials and standard manufacturing processes and are not considered defects.
Damage caused by improper installation, misuse, modification, neglect, or failure to follow care instructions is excluded.
Damage caused by direct soil contact, standing water, moisture retention, fertilizers, chemicals, road salt, or de-icing agents is excluded.
Powder-coated and galvanized steel components are designed for outdoor use but are not maintenance-free. This warranty expressly excludes rust, corrosion, oxidation, or surface degradation occurring after delivery.
Paint chipping, scratching, fading, peeling, bubbling, or wear is excluded.
Coating failure caused by impact, abrasion, freeze-thaw cycles, snow, ice, prolonged moisture exposure, or environmental conditions is excluded.
Minor cosmetic changes over time are considered normal wear and do not constitute a manufacturing defect.
The Geo-Textile liner is a consumable component. This warranty does not cover tearing, clogging, decomposition, biodegradation, or damage caused by roots, soil pressure, gardening tools, or improper use. The liner may be pre-fabricated and may include seams as part of its construction.
6. Product Variations
Product specifications, materials, components, dimensions, and features may be updated, modified, or substituted from time to time without prior notice, provided that such changes do not materially affect the intended use of the product.
7. Warranty Claims
To submit a warranty claim, customers must contact support@livarex.ca within the applicable warranty period and provide the order number, a clear description of the issue, and clear photos of the affected area. Claims submitted without sufficient documentation may be denied.
8. Resolution
If a valid warranty claim is approved, LIVAROCKS, at its sole discretion, may repair the defective component, replace the defective component, or issue a partial refund. Replacement parts do not extend or restart the original warranty period.
9. Shipping and Labour
This warranty does not cover installation or removal costs, labour charges, or shipping and transportation costs unless expressly approved in writing by LIVAROCKS.
10. Limitation of Liability
(a) General Limitation:
To the maximum extent permitted by applicable law, LIVAROCKS, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages whatsoever. This includes, but is not limited to, loss of use, loss of plants or vegetation, damage to decks, patios, or other property, and any costs associated with the removal or re-installation of the product.
(b) Liability Cap:
In no event shall the total aggregate liability of LIVAROCKS arising out of or related to this warranty or the use of its products, whether in contract, tort (including negligence), strict liability, or any other legal theory, exceed the actual amount paid by the customer for the specific product giving rise to the claim.
(c) Statutory Rights Notice:
Some jurisdictions (including the Province of Quebec) do not allow the exclusion or limitation of certain warranties or the limitation of liability for certain types of damages. Therefore, some or all of the above exclusions or limitations may not apply to you, and you may have additional rights under applicable provincial consumer protection laws.
11. Governing Law
This Warranty Policy shall be governed by the laws of the Province of Manitoba and the applicable federal laws of Canada.
Nothing in this policy limits or excludes any rights that consumers may have under applicable provincial consumer protection laws.
12. No Other Warranties
This limited warranty is the only warranty provided by LIVAROCKS. To the extent permitted by law, all other express or implied warranties are disclaimed.
13. Disclaimer on Product Lifespan
Any references to product lifespan, durability, or expected service life are estimates only and do not constitute a warranty or guarantee.
